Voluntary Interview Under Caution
During the course of a criminal investigation, if you are suspected of committing a criminal offence(s) the police may invite you to attend the police station voluntarily to be interviewed under Caution.
If you are arrested and detained in custody, you have the right to choose a Solicitor of your choice either under the Legal Aid Scheme or as a Private Client.
A request by the police for you to attend a voluntary interview is commonly referred to as a Caution + 3 interview and you have a right to consultation with a Solicitor over the telephone, or have one present during the interview. A Solicitor will be aware of your rights and entitlements under the Police and Criminal Evidence Act 1984 (PACE) and the various procedures the police must follow. It is therefore advisable to have a Solicitor present.
Irrespective of your income, everyone is entitled to free legal advice and assistance at the police station. However, you may wish to pay privately for your legal representation. We charge a Fixed Fee for legal representation at your police station interview and our prices are set out below.
The purpose of the interview is for the police to investigate the offence(s) and obtain evidence, by asking you questions about it during the interview and under Caution.
As the interview is voluntary you are not legally required to attend. However, this could result in the police issuing a warrant for your arrest so that you can be legally detained at the police station in order for the interview to take place. It is therefore advised that you attend, and instruct a Solicitor to represent you.
It is therefore important that you contact us as soon as possible if you have arranged a date and time to attend the police station, and/or the date you have arranged is no longer convenient for you.
